Queensland court resolves legal paradox for twins with different biological parents
A surrogate mother in Queensland, Australia, has given birth to twins with entirely different biological parents, a rare medical phenomenon known as heteropaternal superfecundation. The woman, identified in court documents as DZ, had undergone an embryo transfer via IVF in April 2025 as part of an altruistic surrogacy agreement for a couple. Around the same time, she also became pregnant naturally with her own partner.
The twins, a boy and a girl, were born via caesarean section in November 2025. DNA testing confirmed that the girl is the biological child of the intended parents, while the boy is the biological child of the surrogate and her husband.
The case required intervention from the Children's Court of Queensland because state surrogacy laws generally prohibit the separation of “birth siblings” born from the same pregnancy. However, Judge Jodie Wooldridge ruled that the infants were “gestational twins” rather than “birth siblings” under the specific legal definition of the Surrogacy Act. This distinction allowed the two families to legally claim parentage and raise the children separately. Both families have expressed a desire for the children to grow up knowing one another.
