A woman in Queensland, Australia, gave birth to twins in November 2025 who have different biological parents. The situation arose when the woman, acting as a surrogate for a couple using IVF, also became pregnant naturally with her own husband during the same period.

Because the children were born during the same pregnancy, the case required a ruling from the Queensland Children Court. Local surrogacy laws prohibit the separation of twins born during a single surrogacy pregnancy. However, Judge Jodie Wooldridge ruled that the children should be classified as “gestational twins” rather than legal siblings under the specific surrogacy statutes.

This ruling allows the biological parents to maintain legal custody of their respective children: a girl for the intended surrogate parents and a boy for the surrogate mother and her husband. The families have reportedly agreed to the arrangement and intend for the children to know each other as they grow up.
