Rajasthan High Court stays termination of government employee

The Rajasthan High Court has stayed the termination of a government employee who was dismissed following allegations of suppressing information regarding a criminal conviction. The petitioner argued that the conviction had already been stayed by a coordinate bench of the court, making his declaration that he was not an “ex-criminal” a bona fide response.

The court noted that allowing a conviction to remain in operation could cause irreparable career damage to a public servant. The petitioner also raised concerns regarding a violation of the principles of natural justice, claiming he was not provided prior notice before the termination order was issued. The court has issued notice to the respondents regarding the matter.
