Rampart IC withdraws appeal of USPTO patent invalidation decision
Rampart IC, LLC has withdrawn its appeal regarding a United States Patent and Trademark Office (USPTO) decision to invalidate the original claims of U.S. Patent No. 11,660,056.
The USPTO determined that the inventions covered by the original patent were either previously invented by third parties, including Egg Medical, or were obvious variations of existing work. While some claims may survive the reexamination, they will be subject to substantial limitations that narrow the patent's scope.
Egg Medical initiated the reexamination process following a patent infringement lawsuit filed by Rampart in U.S. District Court. Egg Medical has asserted its own prior patent rights and demanded that Rampart cease activities that infringe upon Egg Medical's intellectual property. Egg Medical CEO Robert Wilson stated that the decision reinforces the integrity of the U.S. patent system.
