Regulated sectors demand legal security from presidential candidates
Five major regulated sectors in Brazil have issued an open letter to presidential candidates demanding improvements to the business environment, specifically focusing on regulatory quality and legal security.
The signatories include the Brazilian Association of Airlines (Abear), the Brazilian Association of Highway Concessionaires (ABCR), the National Association and Union of Private Public Service Concessionaires of Water and Sewage (Abcon Sindcon), the National Federation of Supplementary Health (FenaSaúde), and Conexis Brasil Digital.
The entities are calling for strengthened technical, financial, and administrative autonomy for regulatory agencies, as well as staff replenishment. They also advocate for more frequent use of Regulatory Impact Analysis (RIA) and Regulatory Result Evaluation (RRE). According to data from the Getulio Vargas Foundation (FGV) cited in the document, only 18% of regulations produced by agencies between 2021 and 2024 were preceded by an impact analysis.
To reduce judicialization, the groups propose using sectoral regulatory frameworks as references for conflict resolution, encouraging administrative mediation, and reviewing procedural incentives that encourage abusive or repetitive lawsuits. They also seek better coordination between the Judiciary, regulatory agencies, and consumer protection bodies.
