Remote digital signature technology and legal validity in Italy

Remote digital signature technology allows users to sign documents online securely with full legal validity, eliminating the need for physical hardware such as USB tokens or smart cards. This method is particularly useful for professionals, businesses, and citizens managing contracts or administrative procedures remotely.

In the Italian regulatory framework, remote digital signatures are categorized as qualified electronic signatures. They guarantee the authenticity and integrity of a document, providing legal effects equivalent to a handwritten signature. Unlike simple electronic signatures—such as drawing a signature on a PDF—which are easily contestable and suitable only for informal agreements, qualified signatures are highly secure.

To obtain a remote digital signature, users typically undergo an identification process via SPID or video call, after which they receive a PIN and a one-time password (OTP) to authorize signings. Accredited providers in Italy include Poste Italiane, Aruba, InfoCert, and Namirial.
