Remote work equipment use creates legal risks
The transition to remote work has introduced legal and operational challenges, particularly regarding the use of personal equipment for professional tasks. A recent case involving a professional whose personal laptop suffered an irreversible technical failure while performing critical company tasks highlights the risks of informal telework arrangements.
Under Article 75-D of the CLT, contracts must explicitly state provisions for the acquisition, maintenance, and provision of technological equipment. Without a written agreement, companies and employees face legal uncertainty regarding who is responsible for repair or replacement costs when personal hardware is used to meet corporate deadlines.
