Rental market regulations and tenant rights in Poland

The rental market in Poland is facing complexities regarding rent adjustments and tenant rights. Discussions have emerged concerning whether the COVID-19 pandemic serves as a valid basis for tenants to request rent reductions, particularly for those facing job losses and limited budgets.

Regarding legal procedures for rent increases, landlords must provide written notice. For standard rentals, the statutory notice period is typically three months, effective at the end of a calendar month. Subsequent increases cannot occur sooner than six months after the previous one takes effect, though this restriction does not apply to independent utility costs like water or waste management.

While there is no universal maximum limit for rent increases, if the annual rent exceeds 3 percent of the property's replacement value, the landlord must provide a statutory justification. Tenants have the right to request a written explanation and calculation of the increase; failure to provide this within 14 days renders the increase invalid. Tenants may also refuse an increase in writing within two months of the notice, which results in the termination of the lease agreement following the notice period.
