Rep. LaMonica McIver gives birth amid federal assault charges
New Jersey Representative LaMonica McIver announced the birth of her second child on Thursday, even as she continues to face federal legal challenges. McIver is currently facing up to 17 years in prison following an incident in May 2025 at the Delaney Hall immigrant detention facility in Newark.
The charges, which include assaulting, impeding, and interfering with federal law enforcement officers, stem from a chaotic confrontation during a congressional visit to the ICE facility. Prosecutors allege that McIver struck federal agents during a scuffle that occurred when Newark Mayor Ras Baraka was arrested.
A federal appeals court previously denied McIver’s request to dismiss the charges, ruling that the Speech or Debate Clause of the Constitution does not grant legislative immunity for the alleged acts of violence. In a statement, McIver expressed gratitude for her new daughter and noted that the experience serves as a reminder of why she fights for maternal healthcare and the rights of vulnerable populations.
