Rep. LaMonica McIver loses immunity bid in ICE assault case
A three-judge panel of the U.S. Court of Appeals for the Third Circuit has ruled 2-1 that Rep. LaMonica McIver (D-NJ) is not shielded by congressional immunity from two of the three criminal counts against her. The charges stem from a May 2025 incident at the Delaney Hall Immigration and Customs Enforcement (ICE) detention center in Newark, New Jersey, where a confrontation between lawmakers and federal agents occurred.
The indictment alleges that McIver struck and grabbed federal officers during the incident. The court majority held that the physical conduct described in the first two counts is “unambiguously non-legislative” and not integral to the legislative process. The third count has been sent back to the lower court for further review.
Rep. McIver has criticized the decision, stating that it “chills that authority” of representatives to conduct oversight of the executive branch. She maintains that her actions were part of her official duties and has expressed intent to explore further legal options.
