Republika Srpska ordered to repay Technor Energy AS

The Constitutional Court of Bosnia and Herzegovina has rejected a request from the Ministry of Energy and Mining of Republika Srpska to delay the execution of a court ruling. The ruling requires the entity to return 137,446 KM, plus interest and legal costs, to the Norwegian company Technor Energy AS.

The dispute stems from a one-time concession fee paid by the Norwegian firm for the construction of six small hydroelectric plants on the Bosna River. Following the termination of the concession agreements, the Supreme Court of Republika Srpska ruled in June 2026 that the funds must be returned, as the company had proven the payment was made.

The Ministry of Energy and Mining had argued for a stay of execution, citing concerns that Technor Energy AS might enter bankruptcy or liquidation due to recent changes in its ownership and management structures. The Ministry expressed fear that if the money were paid out and a subsequent appeal were successful, the funds might not be recoverable. However, the Constitutional Court determined these reasons were insufficient to halt the enforcement of the judgment. The court's decision only addresses the delay of payment and does not rule on the merits of the ongoing appeal regarding the obligation to repay.
