Rio de Janeiro legislative bodies address councilor status
In Rio de Janeiro, the Rio de Janeiro City Council has decided to wait 30 days before calling a substitute for councilor Fábio Silva (Podemos), who was arrested during a police operation. Following the chamber's internal regulations, the automatic removal of a lawmaker occurs on the 31st day after their arrest is decreed. Currently, no replacement will be seated. Professor Marcelo Martins (Podemos) is the first substitute eligible to take the seat.
Separately, in Angra dos Reis, the Rio de Janeiro State Court (TJ-RJ) has suspended the effects of the removal of councilor Greg Duarte (PL). The decision by Judge Pedro Saraiva de Andrade Lemos allows the lawmaker to potentially resume his duties while the judicial review of the legislative revocation process continues. Duarte's legal team has challenged the legality of the removal procedure, alleging violations of due process and constitutional guarantees.
