Rio Grande do Norte State ordered to pay damages after fatal vehicle collision

The State of Rio Grande do Norte has been ordered by the 3rd Court of the Ceará-Mirim Comarca to pay compensation and pensions following a fatal 2018 accident involving a prison system vehicle.

The collision occurred on December 6, 2018, on the BR-405 highway. A prison vehicle was performing an illegal overtaking maneuver on a continuous line when it struck a motorcycle carrying three people. The accident resulted in the deaths of a 19-year-old woman and her child, approximately one year old.

Judge Airton Pinheiro ruled that while the state vehicle was imprudent, there was concurrent fault because the motorcyclist did not hold a driver's license and none of the occupants were wearing helmets. Consequently, moral damages were set at R$ 50,000, half of the initially proposed R$ 100,000. The state is also required to pay monthly pensions to the beneficiaries of the deceased.
