Rio Grande do Sul court rejects indemnity claims in viral 'betrayal tea' case

The Tribunal de Justiça do Rio Grande do Sul dismissed civil lawsuits stemming from a video that went viral in 2025, in which influencer Natália Knak exposed her partner Rafael Eduardo Schemmer’s alleged infidelities during a baby‑gender‑reveal party. Rafael sought R$ 100,000 for alleged damage to his honor and professional reputation, while Natália requested R$ 150,000 for moral damages, citing repeated betrayals and health concerns during pregnancy.

Presiding judge Eugênio Facchini Neto ruled that no concrete harm to reputation or livelihood could be proven and that the widespread circulation of the video made removal ineffective. The court therefore denied both indemnity requests and ordered that the video remain online. The decision also noted the gender‑revelation context and applied the National Justice Council’s gender‑perspective protocol, characterising Natália’s actions as a response to a series of betrayals rather than an isolated act of revenge.
