Rio Pardo court orders UHE Mimoso to contain aquatic plants
A court has ordered the immediate containment of aquatic plants in the Rio Pardo to prevent irreversible environmental damage. The ruling holds the operator of the UHE Mimoso hydroelectric plant responsible for the proliferation and displacement of macrophytes caused by eutrophication.
Under the injunction, the company must begin collecting dispersed biomass from the riverbed and banks within 48 hours. Additionally, the company is prohibited from performing maneuvers that disperse plants without proper containment and must submit a technical study regarding water quality and environmental impacts within 60 days. The court has also shifted the burden of proof to the company, requiring it to demonstrate that its operations are regular and not contributing to the issue.
