Romania Constitutional Court rules on SAFE program legal conflict

The Romanian Constitutional Court (CCR) has ruled that a legal conflict existed between the Government and Parliament regarding the issuance of Emergency Ordinance no. 38/2026, which established the SAFE program.

The Court found that the Government exceeded its constitutional authority by adopting the ordinance after the Bolojan Government had been removed via a motion of censure on May 5, 2026. The CCR determined that an interim government is only authorized to perform acts necessary for the current administration of public affairs and lacks delegated legislative powers. Additionally, the ordinance improperly regulated legislative solutions that were already undergoing parliamentary procedure.

The SAFE program involves approximately 16.7 billion euros in loans, featuring a maximum interest rate of 3% and a 10-year grace period. While the ruling does not automatically cancel military procurement contracts already signed under the program, it may jeopardize future mechanisms, such as the state's ability to expropriate industrial assets or take stakes in strategic companies.
