Romania: Employee leave and medical indemnity rules for 2026

In Romania, employees have specific rights regarding leave for family emergencies and medical care in 2026. Under the Labor Code, caregivers are entitled to a minimum of 5 working days per year to provide support to a relative (child, parent, or spouse) or a person living in the same household suffering from a serious medical condition. These days are separate from annual leave.

Additionally, employees may be entitled to up to 10 working days per year for unforeseen family emergencies.

Regarding standard medical leave, compensation is calculated based on the duration of the illness and previous income. For common illnesses or non-work-related accidents, the payout percentage varies: 55% for episodes up to 7 days, 65% for 8 to 14 days, and 75% for episodes of 15 days or more. Notably, between February 1, 2026, and December 31, 2027, a special rule applies where the indemnity for temporary incapacity for work is calculated by reducing the total duration by one day, subject to legal exceptions.
