Romania infrastructure: Legal disputes over tenders and land expropriation
Several legal disputes regarding infrastructure projects and land expropriation are unfolding in Romania. In Constanța, the European construction giant STRABAG has contested the tender results for the Tomis - Aurel Vlaicu road passage. The company reportedly placed second in the bidding process, which was led by the Freyom SRL – Procons Group SRL association. The contract award is currently on hold pending the resolution of this contestation.
In Cluj, a legal battle continues over land expropriated 18 years ago for the Transylvania Motorway. The Cluj Tribunal ruled that a significant portion of the 9,055 square meters taken from Fluotex Conf SRL was not used for its intended purpose. Consequently, the land is being returned to the company, which must now repay over 364,000 lei in compensation to the state. The case is currently under appeal by CNAIR and the Ministry of Finance.
Additionally, Dedeman owners Dragoș and Adrian Pavăl have filed a lawsuit against the Romanian state. They are contesting the compensation received for a 133-square-meter plot in Miroslava, Iași, which was used for the Iași bypass. The owners claim the state provided a negligible amount of approximately 1 euro per square meter, whereas they are seeking 250 euros per square meter, alleging they were not legally notified of the original 2020 compensation decision.
