Romania introduces new Urbanism Code for renovations and development
Romania's new Law no. 169/2026, the Territory Planning, Urbanism, and Construction Code, introduces significant changes to real estate development and apartment renovations. Most of the code is set to enter into force on August 25, 2026.
For apartment owners, the new code simplifies the renovation process by allowing certain works to be performed without a construction permit. This includes interior finishes such as painting, plastering, replacing flooring (tiles or parquet), and installing interior woodwork. However, modifications to structural elements—including load-bearing walls, columns, beams, slabs, facades, or common areas of a building—remain subject to strict authorization rules.
Additionally, the law establishes a framework for a local “territory equipping tax.” This allows local authorities to implement fees in areas where urban planning increases land value or intensity of use. The goal is to ensure that the costs for necessary infrastructure, such as roads, utilities, schools, and public services, are partially covered by the beneficiaries of urban development rather than relying solely on public budgets. The specific fiscal regime for this tax will require further updates to the Tax Code.
