Romania: Labor laws regarding night shift pay and eligibility

Under Romanian labor law, employees working night shifts are entitled to specific compensations, such as a 25% increase in their base salary or a reduction in daily working hours without a pay cut. However, working after 10:00 PM does not automatically qualify an individual for this premium.

To be legally classified as a night worker, an employee must meet specific criteria defined in Articles 125 and 126 of the Labor Code. This includes working at least three hours of their daily shift between 10:00 PM and 6:00 AM, or having night work account for at least 30% of their total monthly working time.
