Romania: Legal regulations for tree removal and liability for falling trees

In Romania, the removal of trees is strictly regulated by law, regardless of whether they are located on private or public property. Certain species, such as walnuts and edible chestnuts, as well as secular trees or those with significant ecological value, are protected. Owners may require specific authorization before intervening, even on their own land. Failure to comply with these legal procedures can result in fines reaching tens of thousands of lei or even criminal liability.

Regarding damages caused by falling trees, liability depends on the tree's location and the responsible party. If a tree on public land falls on a vehicle, the owner may seek compensation from the institution or administrator responsible for its maintenance, as Law no. 24/2007 mandates the upkeep of green spaces to prevent accidents. Under the Civil Code, responsibility for damages caused by things under a person's guard exists regardless of fault. If the tree is on private property, compensation must be sought from the individual, company, or homeowners' association that held legal responsibility for the tree.
