Romania legislative proposal B563/2026 mandates lawyer services for contracts

A legislative proposal in Romania, identified as B563/2026, seeks to amend the Civil Code and the Law on the Organization and Exercise of the Legal Profession. The draft proposes that whenever the law requires a written document under private signature for the validity or proof of a contract, that document must be prepared by a lawyer.

Critics, including the organization IMM Romania, are calling for the rejection of the proposal. They argue that the mandate would impose new operational costs and compliance burdens on entrepreneurs, including those managing individual or collective labor contracts and commercial agreements. Opponents suggest the move contradicts European Union policies aimed at reducing administrative burdens and simplifying business processes for startups and SMEs.

The proposal is currently undergoing debate in the Senate and has not yet become law.
