Romania: Maintenance and pension rights for students up to age 26

In Romania, legal provisions ensure that financial support for children can extend beyond the age of 18 under specific conditions. According to the Civil Code, parents are obligated to provide maintenance for their adult children if they are continuing their studies in an organized educational program, provided they do not exceed the age of 26.

Similarly, under Law no. 360/2023 regarding the public pension system, children are entitled to survivor pensions if they continue their studies, also up to the age of 26. To maintain these benefits, students must provide original certificates proving their enrollment in an organized educational or higher education program. For students over 16, these documents must typically be submitted to territorial pension houses within 10 calendar days of the start of the school or university year. Failure to provide proof of continued studies can result in the suspension of pension payments starting November 1 of the current year.
