Romania pension regulations and legal disputes regarding benefits

The Hunedoara County Pension House has issued clarifications regarding restrictions on combining pensions with other types of income. According to the institution, survivors receiving a widow's pension must adhere to monthly income ceilings. Specifically, exceeding the national gross minimum wage may affect the right to combine the pension with professional income. As of July 1, 2026, the guaranteed gross minimum wage is set at 4,325 lei.

Additionally, individuals receiving early retirement pensions face different restrictions. They are prohibited from combining their pension with income from specific employment forms, including individual labor contracts, service reports for public officials, holding elective or appointed positions in public authorities, and being a cooperative member.

In a separate legal development, the Ilfov Tribunal ruled in favor of a pensioner, ordering the Ilfov County Pension House to recalculate benefits. The court mandated the recognition of years worked in the second labor group at 100%, requiring the institution to issue a new pension decision with retroactive effect from October 7, 2025. This case highlights a broader trend, with an estimated 25,000 legal disputes currently existing between pensioners and pension institutions regarding the recognition of special working conditions.
