Romania property regulations: Land zoning and tree protection laws

Property owners and prospective buyers in Romania face various legal and administrative requirements regarding land acquisition and vegetation management.

When purchasing land for construction, particularly in regions like Sibiu, buyers must distinguish between urban (intravilan) and extra-urban (extravilan) plots. Many transactions in Sibiu involve agricultural extra-urban land, which may require lengthy procedures to permit construction. Essential steps include obtaining an urban planning certificate to verify building height, land occupancy percentages, and setbacks, as well as ensuring the plot has legal road access.

Additionally, private property ownership does not grant unlimited rights over vegetation. Cutting certain trees is prohibited under various legal frameworks, including the Forestry Code, Natura 2000 protections, and laws regarding remarkable trees. While private urban plots have some exceptions, cutting trees within the national forest fund or in protected natural areas can constitute an offense.
