Romania: Proposed law to allocate defense contract penalties to staff

A legislative proposal submitted to the Romanian Senate suggests that a portion of damages collected by the Ministry of National Defense from companies failing to meet contract obligations could be distributed to personnel.

The draft law (B571/2026) proposes a specific breakdown for funds recovered from penalties related to unfulfilled, delayed, or poorly executed public procurement contracts: 40% to the state budget, 30% to the Ministry of Defense's own revenues, 20% to a fund for updating military pensions, and 10% to a fund for personnel bonuses.

Under the proposal, bonuses would not be distributed to all ministry employees. Instead, they would be reserved for military personnel and civilian employees directly involved in the preparation, negotiation, monitoring, or recovery of the specific contract from which the funds were obtained. The project specifies that these payments are contingent upon the actual collection of funds rather than being guaranteed sums.
