Romania Constitutional Court reviews pension law provisions
The Romanian Constitutional Court (CCR) is set to analyze two cases concerning the constitutionality of several provisions within the new pension law (Law no. 360/2023), which took effect on September 1, 2024. The contested articles include regulations regarding the pension calculation formula, the value of the reference point, the granting of stability points, and the utilization of certain work periods.
Additionally, the court is examining procedural aspects, such as the 45-day deadline for pensioners to contest decisions made by territorial pension houses and the six-month timeframe for submitting documents required for pension recalculation. The rulings could significantly impact ongoing litigation between retirees and pension institutions.
Separately, discussions regarding retirement age continue in the political sphere. Future Labor Minister Florin Manole addressed potential changes to retirement ages for police and military personnel, though his statements regarding the gradual increase in military retirement age toward 2035 appeared to conflict with existing legislation (Law no. 282/2023).
