Romanian Supreme Council of Magistracy Rejects Proposed Salary Law
The Supreme Council of Magistracy (CSM) sent an opinion to the Ministry of Justice saying the draft Law on Salaries for personnel paid from public funds contains several constitutional defects. It argues that judges' and prosecutors' remuneration must be set by a special law and that the draft was introduced by the interim Bolojan government in breach of constitutional rules that bar a dismissed government from proposing legislation.
CSM said the draft violates the 2022 Law on the status of judges and prosecutors, threatens the financial independence of the judiciary and includes ambiguous provisions on transitional salary differences. The council warned that the law would undermine judicial independence and the rule of law in Romania.
In response, the CSM's sections for judges and prosecutors decided to convene general assemblies of courts of appeal, tribunals, magistrates' courts and prosecutors on 9 June 2026 to adopt a collective position opposing the bill.
