Romanian Supreme Court warns Parliament of constitutional flaws in public salary law

The Romanian Supreme Court (Înalta Curte de Casație și Justiție) sent letters to the Senate President Mircea Abrudean and the Chamber of Deputies President Sorin Grindeanu on 27 July 2026, urging both houses to ensure that the legislative process for the new public salary law complies strictly with the Constitution. The Court highlighted “serious doubts” about the law’s validity, noting that the Ministry of Labor acted as the de‑facto initiator of the bill, which raises issues of separation of powers, judicial independence and procedural legality.

The Court warned that if Parliament proceeds with the draft in its current form it will refer the matter to the Constitutional Court. Trade union confederations have demanded the law’s withdrawal, warning of a possible loss of €770 million from the national recovery fund (PNRR). The Supreme Court’s statements call for effective consultation with the judiciary and compliance with constitutional requirements before the law can be adopted.
