Romania's ANAF crypto tax controls could trigger widespread litigation
Romania's National Agency for Fiscal Administration (ANAF) is tightening oversight of crypto‑related activities. The recently issued Ordinance 750/2026 requires crypto service providers to file detailed annual reports on user accounts, balances and each transaction. ANAF officials also plan to create a dedicated division for monitoring crypto transactions.
Experts warn that the country's fiscal legislation remains vague for companies operating in the crypto sector. There are no clear accounting rules for recognizing revenue from mining, DeFi or staking activities, and EU member states differ on treatment. Lawyer Luisiana Dobrinescu cautioned that this regulatory “fog” could become a massive source of litigation for businesses and the tax authority alike, and suggested a possible tax amnesty could further complicate matters.
