Rome Court Rejects €11.3bn Seizure Request in Tutor Speed Control Case

On 28 July, the Rome Tribunal, presided over by Judge Maria Ciccolo, rejected a request by Alessandro Patanè to impose a conservatory seizure of up to €11.286 billion on assets of Autostrade per l’Italia, Holding Reti Autostradali, Mundys, Cdp Equity and Cassa Depositi e Prestiti. The court also dismissed a subordinate request to appoint a judicial administrator to force the company to set up a risk fund and block further disposition of assets, stating that current evidence does not justify freezing the companies’ assets while the case proceeds.

Patanè, claiming exclusive rights to the “AP Consulting” software that underlies the Sicve system known to drivers as Tutor, argued that a customized version was supplied to Autostrade between September and November 2004 via Multinetworks and that later versions were installed through 2007 without transfer of ownership. He sought joint liability for the €11.286 billion claim, interest, revaluation, a licence within 30 days, a daily penalty of €500,000 for delay, prohibition of further use, and an immediate provisional sum of €56.43 million. The defendant companies contested the ownership, originality, and credit valuation.
