Roraima state government faces restrictions on ICMS tax credit transfers
The Court of Accounts of Roraima (TCE-RR) has issued a precautionary injunction prohibiting the state government from authorizing the use or transfer of certain ICMS (Tax on Circulation of Goods and Services) credits. The decision follows the identification of potential irregularities in a recent state decree.
The injunction targets State Decree No. 41.572-E, which allowed companies to maintain, use, and transfer presumed ICMS credits accumulated from export operations. Preliminary analysis by the TCE-RR suggests the decree may have improperly extended tax benefits to operations not covered by state legislation, specifically involving goods that were not industrialized within Roraima.
Auditors expressed concerns that the measure could risk state revenue by allowing retroactive benefits dating back to October 2021. The court also noted a lack of sufficient documentation to prove the financial impact of the measure on state collections.
