Roy Suryo's Pretrial Petition Does Not Automatically Remove Suspect Status

Legal analyst Muhammad Gumarang explained that Roy Suryo's pretrial (praperadilan) filing to the South Jakarta District Court concerns only the legality of his arrest and detention, not the validity of his designation as a suspect. Under Indonesian criminal procedure, a suspect status remains in place unless at least two pieces of admissible evidence are invalidated or the suspect was never examined as a witness or suspect. Gumarang noted that while the arrest can be contested, the suspect status can only be challenged if foundational evidence is dismissed.

The petition, filed after a brief detention, seeks to test whether the police followed proper procedures during the arrest. The analyst indicated that the impact on Suryo's suspect status is limited, as the court's review will focus on procedural compliance rather than the substantive evidentiary basis of the case.
