Central Bank of Russia seeks bailiff access to Euroclear
The Central Bank of Russia (CBR) has requested that a bailiff be granted access to the Belgian depository Euroclear to collect, describe, and preserve documents. The request was presented to the Commercial Court in Brussels. Russian lawyers have specifically requested that the bailiff be accompanied by an information technology specialist.
The legal action follows claims from Russia that European Union institutions and Euroclear representatives agreed to legislative changes this summer that would disadvantage the Russian bank. Currently, approximately 193 billion euros of CBR assets are frozen within Euroclear.
The European Union has been discussing the possibility of using these frozen funds to support Ukraine for over a year. While the European Council previously opted to provide a 90 billion euro loan to Ukraine due to a lack of consensus, officials confirmed that the use of Euroclear assets remains under discussion. Russia and Euroclear are involved in counter-lawsuits, some of which are being reviewed by the Belgian court system.
