Salmon Arm wins privacy dispute over wildfire records
B.C.’s Information and Privacy Commissioner has ruled in favor of the City of Salmon Arm following a Freedom of Information dispute. Adjudicator D. Hans Hwang upheld the city's decision to withhold certain information from a local property owner.
The dispute centered on a request for records regarding a Section 219 Wildfire Interface Covenant registered on the applicant's property title. While the city provided some responsive records, it withheld specific details citing solicitor-client privilege, local public body confidences, potential harm to financial interests, and the protection of third-party privacy.
Although mediation through the Office of the Information and Privacy Commissioner (OIPC) led to the disclosure of some additional information, the property owner maintains that the city failed to meet its legal obligation to assist applicants fully and accurately under the Freedom of Information and Protection of Privacy Act (FIPPA). The applicant also argued that the information should have been released in the interest of public transparency.
