Sam Bankman-Fried appeals conviction to US Supreme Court
Former FTX CEO Sam Bankman-Fried is seeking a review of his criminal conviction from the United States Supreme Court. His legal counsel, Jeffrey Fisher of Hecker Fink LLP, has filed a petition for a writ of certiorari following the upholding of Bankman-Fried’s conviction by the Second Circuit in June 2026.
The appeal rests on two primary arguments. First, the defense contends that the criminal trial improperly used irrelevant losses incurred by FTX customers to determine criminal charges. Second, the petition argues that the $11 billion forfeiture order imposed on Bankman-Fried violates the Eighth Amendment.
The Supreme Court has extended the deadline for the government to respond to the petition to November 16. A decision on whether the justices will hear the case is expected in late 2026 or early 2027. If the court accepts the case, a ruling could be issued by June 2027, potentially leading to a new trial.
