Samarco and Sérgio Cabral face major convictions in Brazil
The Federal Regional Court of the 6th Region (TRF6) has convicted Samarco Mineração S/A and three former managers for their roles in the 2015 Fundão dam collapse in Mariana, Minas Gerais. The court overturned a previous acquittal, ruling that the company and its executives, including Germano Silva Lopes, Daviély Rodrigues Silva, and Wagner Milagres Alves, were aware of the risks but ignored warnings. Samarco was prohibited from contracting with the public sector for ten years and ordered to pay approximately R$ 7.2 million in fines and environmental funds. The individual managers received prison sentences ranging from 7 to 8 years and 9 months.
Separately, the Rio de Janeiro Court of Justice (TJRJ) convicted former governor Sérgio Cabral for administrative improbity. The ruling found that a structured scheme existed within the prison system to provide Cabral with luxury privileges during his incarceration between 2016 and 2018. These privileges included a 65-inch television, home theater systems, gourmet food, and unauthorized visits. Cabral was ordered to pay a fine equivalent to 12 times his last salary and R$ 1 million in collective moral damages. Several prison officials and the former Secretary of Penitentiary Administration were also convicted.
