San Jose police officer fired for misusing Flock camera data

A San Jose police officer has been fired for misusing the department’s Flock license plate tracking system to assist a relative involved in a domestic abuse case. According to Police Chief Paul Joseph, the officer used his personal phone to access the database without authorization to track the vehicle of a woman who was allegedly being abused by the officer’s cousin.

The victim discovered the breach after the suspect informed her that he knew her location. While the department has referred the case to the Santa Clara County District Attorney’s office and the Commission on Peace Officer Standards and Training for potential decertification, neither the officer nor the cousin has been criminally charged. Legal analysts noted that because the officer had authorized access to the system, his misuse may not currently meet the threshold for criminal prosecution under existing statutes.

In response to the incident, the San Jose Police Department has prohibited officers from accessing the system on personal devices and is testing new auditing tools to flag unauthorized access. Chief Joseph called the incident a severe betrayal of public trust and suggested that state lawmakers should pass legislation to make such violations easier to prosecute as crimes.
