San Juan Municipality sued over Escambrón parking project
A group of residents has filed a lawsuit against the Municipality of San Juan to halt a proposed parking lot project in the Escambrón area. The legal challenge seeks to nullify Ordinance Number 4, arguing that the municipality lacks the legal authority to alienate the land due to a lack of title and other procedural defects.
The plaintiffs contend that the project is an attempt at privatization. They argue that the municipality intends to segregate a parcel of land to create an enclosed estate, which would later become an independent plot following the construction of the parking lot. The lawsuit emphasizes that the land is legally designated for outdoor recreation.
Additional concerns raised in the lawsuit include the lack of certification regarding the maritime-terrestrial zone boundaries and the fact that the site is located in a flood-prone area and a tsunami evacuation zone. The plaintiffs argue that these environmental factors prohibit the construction of permanent structures. Furthermore, the lawsuit alleges that the public hearing process was merely performative and failed to genuinely evaluate community input.
