Santa Catarina court orders parents to pay R$ 100,000 after expelling son

The Court of Justice in Santa Catarina has ordered parents to pay R$ 100,000 in moral damages to their teenage son for affective abandonment. The ruling follows the adolescent being threatened and expelled from his home after revealing his sexual orientation.

In addition to the expulsion, the father reportedly exposed the teenager's private life on social media. The Public Ministry obtained an injunction to remove the discriminatory content, establishing a daily fine of R$ 2,000 for any further violations. A psychological evaluation conducted during the proceedings identified a domestic environment characterized by psychological violence, authoritarian practices, and affective negligence.

Prosecutor Tito Gabriel Cosato Barreiro stated that the conviction is based on the failure to fulfill legal duties of care, protection, and welcoming, rather than a state-mandated requirement for affection. The case highlights the legal protections afforded to youth under the Brazilian Constitution and the Statute of the Child and Adolescent (ECA).
