Santa Fe Senate approves mandatory drug testing for public officials

The Senate of Santa Fe has granted preliminary approval to a legislative project that mandates compulsory toxicological examinations, known as ‘narcotests’, for officials across all three branches of the state government. The initiative, proposed by Senator Osvaldo Sosa, targets elected officials and political appointees, ranging from the governor and vice-governor to ministers, legislators, members of the judiciary, and police leadership.

The project aims to promote transparency, institutional integrity, and the prevention of illegal substance use. Under the proposal, tests would be free and mandatory, conducted within 30 days of assuming office, annually, and through random selection via transparent draws. Additionally, tests may be triggered by substantiated complaints.

A positive result would not automatically lead to punitive measures. Instead, the project outlines an interdisciplinary approach focusing on assistance, guidance, and evaluations regarding the individual’s fitness for their role, while ensuring confidentiality and the right to defense.
