Santiago Court annuls property transfer to SLEP Santiago Centro
The Santiago Court of Appeals has annulled the transfer of two properties to the Servicio Local de Educación Pública (SLEP) Santiago Centro, following a protection appeal filed by the Corporación de Desarrollo de Santiago (Cordesan).
The ruling, issued by the court's Sixth Chamber, determined that the Dirección de Educación Pública acted arbitrarily by including properties owned by a private entity in the list of assets transferred to the public education service. The properties in question are located at Las Rosas 1741-1743 and Agustinas 2492, housing the Escuela Básica Libertadores de Chile and Miguel de Cervantes y Saavedra Anexo A-8.
The court emphasized that Cordesan is a private, non-profit legal entity and not a municipal corporation or a state administration organ. The judgment noted that even though the mayor may propose board members or the entity receives specific municipal subsidies, its legal nature remains private, meaning its assets cannot be automatically transferred as fiscal or municipal property.
