Santiago Court blocks release of Miguel Crispi's institutional emails

The Santiago Court of Appeals has suspended the release of institutional emails belonging to Miguel Crispi, a former advisor to the Presidency. This decision overturns a previous mandate from the Council for Transparency (CPLT) that had ordered access to all messages in his official account.

The court's Sixth Chamber ruled that the request was overly broad, as it sought the entirety of his communications over an extended period without specifying particular administrative decisions or procedures. The judges noted that an institutional email account may contain personal messages, strategic analyses, or deliberations that are not directly linked to public administrative acts.

Furthermore, the court emphasized that the use of state technological infrastructure does not strip communications of their constitutional protection regarding the inviolability of private communications. The ruling stated that holding a public office does not constitute a general waiver of privacy rights. The court also dismissed the possibility of redacting sensitive information, citing the excessive complexity involved in such an exhaustive review.
