Sardinia Region appeals to Tar over transfer of 41 bis inmates

The Sardinia Region has filed an appeal with the Regional Administrative Court (Tar) against the Italian Ministry of Justice. The legal action seeks access to documents regarding the decision to transfer a large number of inmates under the ‘41 bis’ special prison regime to the island.

Regional President Alessandra Todde criticized the Ministry for a lack of institutional collaboration, noting that a request for access to these documents made on August 4 went unanswered. The first transfers of inmates under this regime occurred on September 5 at the Utas prison facility, an event the regional government claims it only learned about through medical staffing requests at a local health authority.

Todde argued that the decision discriminates against Sardinia compared to other regions and places an undue burden on the local prison and healthcare systems. She highlighted that facilities like Utas and Bancali are already operating beyond capacity and facing staff shortages, while the regional healthcare system must now manage complex clinical needs of the transferred inmates without state compensation.
