Saskatchewan Crown seeks Supreme Court review of former Mountie Bernie Herman manslaughter case

The Attorney General of Saskatchewan has filed an application for the Supreme Court of Canada to review the conviction of former RCMP officer Bernie Herman. Herman was found guilty of killing his lover, Braden Herman, in May 2021. He was originally charged with first‑degree murder, later reduced to second‑degree murder and ultimately to manslaughter on the basis of provocation, receiving an 11‑year sentence that was cut to eight years by the Saskatchewan Court of Appeal in April 2026.

The Crown argues that Braden Herman’s conduct does not meet the Criminal Code criteria for provocation and that the appeal court erred in allowing the manslaughter conviction to stand. A decision on whether the Supreme Court will hear the case is expected later this year.
