Saskatchewan employer convicted in first foreign worker exploitation case

Dyan Jeny Enterprises has been convicted in a Moose Jaw, Saskatchewan court for the exploitation of a foreign worker. The company pleaded guilty to demanding $12,000 from an employee, Parth Patel, as a condition for maintaining his Canadian work permit. The employee was allegedly told he would lose his job and immigration status if the payment was not made.

As part of the sentencing, the company was ordered to pay a $5,000 fine and repay the $12,000 to the worker. Provincial Court Judge Steven Schiefner characterized the conduct of the company and its principals as “atrocious.”

This case marks the first successful prosecution under Saskatchewan’s new Immigration Services Act, which took effect in July 2024. The legislation was designed to provide the province with more autonomy over immigration and to prevent the exploitation of foreign workers. Under the new law, corporations can face fines of up to $1,250,000.
