Save Long Beach Island to sue U.S. Department of Commerce over whale habitat

Save Long Beach Island (LBI), a New Jersey-based organization, has announced intentions to file a lawsuit against the U.S. Department of Commerce. The legal action seeks to compel the National Oceanic and Atmospheric Administration (NOAA) to reconsider a denied petition to designate critical migratory habitats for the endangered North Atlantic right whale along the East Coast.

The petition specifically requests that NOAA exclude offshore wind complexes from these designated habitats and asks the Department of the Interior to analyze the impact of underwater noise from wind projects on whale migration. This move follows a July 22 denial by NOAA. Conservationists have noted the urgency of the situation, as NOAA figures indicate the species population has dwindled to approximately 380 individuals, with only about 70 reproductively active females.

While grassroots groups are pursuing litigation, larger environmental advocacy organizations, including the Sierra Club and the Natural Resources Defense Council (NRDC), have not yet joined the effort or responded to correspondence regarding the matter.
