Saxon State Social Court overturns disability designation ruling

The Saxon State Social Court (LSG Sachsen) has overturned a favorable ruling regarding the 'Merkzeichen B' disability designation. Although a court-appointed expert initially confirmed the plaintiff's need for assistance, the higher court ruled that the expert's assessment was insufficient.

The court found that the expert had relied too heavily on the plaintiff's subjective descriptions without objectively verifying them against other medical findings. The LSG emphasized that experts must substantiate a claimant's statements through independent medical evidence rather than simply adopting their self-reported information. The Federal Social Court (Bundessozialgericht) subsequently rejected an appeal, upholding the decision that the original assessment lacked necessary objective rigor.
