Scotland to implement new damp and mould regulations for landlords

New regulations regarding damp and mould in rented properties are set to take effect in Scotland this October. Under the Investigation and Commencement of Repair (Scotland) Regulations 2026, landlords will be required to investigate reports, provide written summaries to tenants, and initiate repairs within specific timeframes. Government guidance suggests investigations should typically occur within 10 working days, with written summaries provided within three days of the investigation and repairs starting within five working days.

Data from the Scottish Housing Regulator indicates that over 40,000 social housing landlords have resolved damp and mould cases, with an average resolution time of 26 days. The report noted that 92% of resolved cases did not recur. Condensation was identified as the cause for 52% of reopened cases. In response to the upcoming legal requirements, landlords have been investing in staff training and housing management software.

While the regulations aim to protect tenants, an advisory board to the Scottish government has warned that the new laws could potentially deter investment and lead some private landlords to exit the market.
