SEC submits crypto custody rule overhaul to White House for review

The U.S. Securities and Exchange Commission (SEC) has submitted a proposal to the White House Office of Management and Budget (OMB) to overhaul and modernize its crypto custody rules. The proposal, titled “Amendments to the Custody Rules,” was sent for review on August 25, 2026.

The rulemaking aims to clarify the regulatory framework for how investment advisers and investment companies hold digital assets for clients. It seeks to update existing requirements that were established before the rise of cryptocurrency and remove outdated provisions that the SEC deems no longer necessary for investor protection.

This move represents a significant shift in regulatory direction under SEC Chair Paul Atkins, moving away from the more restrictive safeguarding proposals seen in 2023. The proposal targets requirements under both the Investment Advisers Act and the Investment Company Act. Once the White House review is complete, the SEC is expected to publish the formal proposal, potentially by October 2026, followed by a public comment period of at least 60 days.
